This Privacy Policy applies to all information that the SPORT CITY Online Store, located at sportcity.ua, may obtain about the User while using the website, programs and products of the Online Store.
1. DEFINITIONS
1.1 This Privacy Policy uses the following terms:
1.1.1. "Online Store Site Administration (hereinafter - Site Administration)" - authorized employees responsible for managing the site, acting on behalf of the SPORT CITY online store, who organize and carry out the processing of personal data, as well as determine the purposes of processing personal data, the composition of personal data subject to processing, and the actions or operations performed with personal data.
1.1.2. "Personal data" - any information relating directly or indirectly to a specific individual User (subject of personal data).
1.1.3. "Processing of personal data" - any action (operation) or set of actions (operations) performed with or without the use of automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.1.4. "Confidentiality of personal data" - a requirement mandatory for the Administrator or any other person who has gained access to personal data to prevent their disclosure without the consent of the personal data subject or the existence of another legal basis.
1.1.5. "User of the SPORT CITY Online Store site" - a person who has access to the Site via the Internet and uses the Online Store Site.
1.1.6. "Cookies" - a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends back to the web server each time in an HTTP request when attempting to open a page of the relevant site.
1.1.7. "IP address" - a unique network address of a node in a computer network built on the IP protocol.
2. GENERAL PROVISIONS
2.1. The User's use of the Online Store site signifies agreement with this Privacy Policy and the terms of processing the User's personal data.
2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the Online Store site.
2.3. The Privacy Policy applies to the "SPORT CITY" website and mobile application (for iOS and Android). The Online Store does not control and is not responsible for third-party sites that the User may visit via links available on the Online Store site.
2.4. The Site Administration does not verify the accuracy of personal data provided by the User of the Online Store site.
3. SUBJECT OF THE PRIVACY POLICY
3.1. The Privacy Policy establishes the obligations of the Online Store Site Administration regarding non-disclosure and ensuring the confidentiality protection regime for personal data that the User must provide to the Site Administration upon request when registering on the Online Store site or when placing an order to purchase Goods.
3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out the registration form on the SPORT CITY Online Store Site in the registration section and includes the following information:
3.2.1. User's full name;
3.2.2. User's contact phone number;
3.2.3. email address;
3.2.4. Goods delivery address;
3.2.5. User's place of residence.
3.3. The Online Store protects Data that is automatically transmitted during the viewing of advertising blocks and when visiting pages where a statistical system script ("pixel") is installed:
IP address;
cookie information;
information about the browser (or other program that accesses the display of advertising);
access time;
the address of the page where the advertising block is located;
referrer (address of the previous page).
3.3.1. Disabling cookies may result in the inability to access parts of the Online Store site that require authorization.
3.3.2. The Online Store collects statistics on the IP addresses of its visitors. This information is used to identify and resolve technical problems, and to monitor the legality of financial payments made.
3.4. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is subject to secure storage and non-disclosure, except in cases provided for in clauses 5.2 and 5.3 of this Privacy Policy.
4. PURPOSES OF COLLECTING USER PERSONAL INFORMATION
4.1. The Online Store Site Administration may use the User's personal data for the following purposes:
4.1.1. Identification of a User registered on the Online Store site, for placing an order and (or) concluding a remote sales contract for goods with the SPORT CITY Online Store.
4.1.2. Providing the User with access to personalized resources of the Online Store Site.
4.1.3. Establishing feedback with the User, including sending messages and inquiries related to the use of the Online Store Site, providing services, and processing requests and applications from the User.
4.1.4. Determining the User's location to ensure security and prevent fraud.
4.1.5. Confirming the accuracy and completeness of the personal data provided by the User.
4.1.6. Creating an account for making purchases, if the User has consented to the creation of an account.
4.1.7. Notifying the User of the Online Store Site about the status of an Order.
4.1.8. Processing and receiving payments, confirming tax or tax benefits for the User.
4.1.9. Providing the User with effective customer and technical support in case of problems related to the use of the Online Store Site.
4.1.10. Providing the User, with their consent, with product updates, special offers, pricing information, news mailings and other information on behalf of the Online Store or on behalf of the Online Store's partners.
4.1.11. Carrying out advertising activities with the consent of the User.
4.1.12. Providing the User with access to the sites or services of Online Store partners for the purpose of obtaining products, updates and services.
5. METHODS AND TERMS FOR PROCESSING PERSONAL INFORMATION
5.1. The User's personal data is processed without time limitation, by any legal means, including in personal data information systems with or without the use of automation tools.
5.2. The User agrees that the Site Administration has the right to transfer personal data to third parties, in particular, courier services, postal service organizations, and telecommunications operators, exclusively for the purpose of fulfilling the User's order placed on the SPORT CITY Online Store Site, including delivery of Goods.
5.3. The User's personal data may be transferred to authorized government authorities of Ukraine only on the grounds and in the manner established by the legislation of Ukraine.
5.4. In the event of loss or disclosure of personal data, the Site Administration informs the User about the loss or disclosure of personal data.
5.5. The Site Administration takes the necessary organizational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, distortion, blocking, copying, distribution, as well as from other unlawful actions by third parties.
5.6. The Site Administration, together with the User, takes all necessary measures to prevent damage or other negative consequences caused by the loss or disclosure of the User's personal data.
6. OBLIGATIONS OF THE PARTIES
6.1. The User is obligated to:
6.1.1. Provide personal data information necessary for using the SPORT CITY Online Store Site.
6.1.2. Update and supplement the provided personal data information in case of changes to such information.
6.2. The Site Administration is obligated to:
6.2.1. Use the information received exclusively for the purposes specified in section 4 of this Privacy Policy.
6.2.2. Ensure that confidential information is kept secret, not disclosed without the prior written consent of the User, and not to sell, exchange, publish, or otherwise disclose the User's transferred personal data, except as provided in clauses 5.2 and 5.3 of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure usually used to protect this kind of information in existing business practice.
6.2.4. Block personal data relating to the relevant User from the moment of the User's or their legal representative's or authorized personal data protection body's request, for the period of verification, in case of detection of inaccurate personal data or unlawful actions.
7. LIABILITY OF THE PARTIES
7.1. The Site Administration, having failed to fulfill its obligations, bears responsibility for losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of Ukraine, except in cases provided for in clauses 5.2, 5.3 and 7.2 of this Privacy Policy.
7.2. In case of loss or disclosure of Confidential information, the Site Administration bears no responsibility if this confidential information:
7.2.1. Became public knowledge before its loss or disclosure.
7.2.2. Was received from a third party before it was obtained by the Site Administration.
7.2.3. Was disclosed with the consent of the User.
8. DISPUTE RESOLUTION
8.1. Before filing a lawsuit in disputes arising from the relationship between the User of the Online Store site and the Site Administration, it is mandatory to file a claim (a written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim, within 30 calendar days from the date of receipt of the claim, notifies the claimant in writing of the results of the claim review.
8.3. If no agreement is reached, the dispute will be referred to a judicial authority in accordance with the current legislation of Ukraine.
8.4. The current legislation of Ukraine applies to this Privacy Policy and the relationship between the User and the Site Administration.
9. ADDITIONAL TERMS
9.1. The Site Administration has the right to make changes to this Privacy Policy without the User's consent.
9.2. The new Privacy Policy comes into effect from the moment it is posted on the Online Store Site, unless otherwise provided by the new version of the Privacy Policy.
9.3. All suggestions or questions regarding this Privacy Policy should be reported to the "Contact center" section.
9.4. The current Privacy Policy is posted on the page at "https://sportcity.ua/politika-konfidentsialnosti/".
10. "SPORT CITY" MOBILE APPLICATION
10.1. This Privacy Policy also applies to the "SPORT CITY" mobile application for iOS and Android operating systems (hereinafter - the Application), which is part of the Online Store service.
10.2. While using the Application, the Site Administration may process the following data: last name, first name, patronymic, phone number, email address, delivery address, order history and bonus balance, as well as technical device data (model, operating system version, installation identifiers) and Application usage data necessary for its operation, authorization and support.
10.3. Authorization in the Application is carried out by phone number with confirmation via a one-time code (SMS). Authorization data is stored on the User's device in secure storage and transmitted to the server only via a secure connection (HTTPS).
10.4. The Application does not collect data for displaying third-party advertising and does not transfer personal data for tracking the User between third-party applications and sites.
11. DELETION OF ACCOUNT AND PERSONAL DATA
11.1. The User has the right to delete their account and associated personal data at any time.
11.2. The account can be deleted directly in the Application: "Profile" section → "Delete account" → confirmation of the action. In addition, a request to delete an account can be sent to order@sportcity.ua or through the "Contact center" section.
11.3. After deletion, the User's personal data (last name, first name, patronymic, phone number, email address, delivery address) is anonymized or deleted, all sessions and access tokens are revoked, and further access to the account becomes impossible.
11.4. Data on completed orders and settlements may be stored in anonymized form (without direct personal identifiers) for the period established by the tax and accounting legislation of Ukraine.
11.5. Deletion requests sent by email are processed within a reasonable time, but no later than 30 calendar days from the date of receipt of the request.
12. GEOLOCATION AND APPLICATION PERMISSIONS
12.1. The Application may request access to device geolocation (approximate or precise location) solely to display nearby stores and sort them by distance. Granting this permission is voluntary; if refused, the Application continues to work without the nearest stores feature.
12.2. Location data is used on the User's device and is not stored on the Site Administration's server.
12.3. The Application may request access to the camera solely for scanning product barcodes. Images from the camera are not stored or transferred to third parties.
12.4. Any granted permission (geolocation, camera, notifications) can be revoked by the User at any time in the operating system settings of their device.
13. TRANSFER OF DATA TO THIRD PARTIES AND USER RIGHTS
13.1. To fulfill orders, personal data may be transferred to delivery services (in particular, "Nova Poshta") and payment operators to the extent necessary for delivery and payment. Such parties process data in accordance with their own privacy policies.
13.2. The User has the right to receive information about their personal data, request its clarification, updating, blocking or deletion, as well as to withdraw consent to the processing of personal data, by contacting order@sportcity.ua.
13.3. The Service and Application are not intended for persons under 16 years of age; the Site Administration does not knowingly collect personal data of such persons.
